I have a question regarding inventions that use other products. for example: If I created a jewelry box out of wood and then purchased a legally licensed sticker of a Barbie doll and placed it on this jewelry box then sold it on say ebay would I be violating any trademark or other company protections Reply to this

John, I have bought other products from other companies to create my inventions and then resold them. In your case you may be using a Barbie trademark to sell your product. Someone might think they were buying an official Barbie product. If your stickers do not have the word Barbie or anything associated with that that company on them, it would be OK... For instance I own the Trademark "HURRICANE SURVIVOR". If someone makes a product and puts a sticker on it that says "HURRICANE SURVIVOR" and resold that product: It would be trademark infringement.. But if you bought my product and didn't alter it.. You could resell as many as you wanted on E-bay.. Which is done by millions everyday. I suggest you just sell your wooden jewelry box without any Barbie logo.. and create your own sticker.. to be sold as an accessory for the Barbie products. Hope this helps and keep being creative.. I would agree making your own sticker sounds like the way to go here. Because putting a barbie sticker on a product that is not made by Mattel would in essence be false advertisement and tricking customers into thinking they are getting a genuine barbie product. I would say using the same color scheme in the sticker would be ok.
